An officer saw a white '94 Nissan Maxima speeding 39 in a 25 MPH zone northbound on Oak Park Avenue; he stopped the vehicle at 13th and Oak Park. The driver actually had a valid license and insurance. However, his breath was alcoholic; his eyes, bloodshot and watery. The officer asked the 29-year-old Chicago man to step out of the car to do a few sobriety tests. The man stated that he knew his alphabet. He was asked to recite it beginning with D through Z. He got from D to H; he started over at B and reached J. He was unable to stand on one leg. He could not touch his fingers to his nose without looking. He could not touch his nose without losing his balance, either. The breathalyzer test showed his blood alcohol level was .115, above the .08 needed for the DUI arrest which naturally followed.
